How do you say this in Japanese? 文法本の中で 今何時ですか？ 今1時です。 は 「今は何時ですか？」に使いません。 つまりあの「は」使わないと書いてありますが、でも実際会話の中で、本当に「は」は使わないですか？ あと、疑問する時 「ですか ますか 」の後は 疑問符？は使いません。全部句点「。」を使いますが、でも実際そうではないですよね？普通に疑問符も使いますよね？

「今何時ですか？」の方が自然に聞こえます。理由は2つあります。
1つ目の理由は、「今は何時ですか？」と尋ねられると、過去の時間や、未来の時間と比較しているように聞こえます。つまり、過去でもなく未来でもない「今」を強調しているように聞こえます。
例1：「〇〇くん、今は何時ですか？」「先生ごめんなさい。寝坊をしてしまい、遅刻してしまいました。」
例2：「ぼくの時計10分遅れていて、さっき見たときは2時でしたよ。」「それで、今は何時ですか？」
2つ目の理由は、「今は何時ですか？」は丁寧に聞こえます。つまり、目上の人に尋ねる時の言葉に聞こえます。
例：「〇〇くん、この仕事を3時までにやってくれるかな？」「承知しました。申し訳ないのですが、今は何時ですか（orでしょうか）？時計を忘れてきてしまいました。」
2つの理由のうち、どちらかにあてはまる場合「今は何時ですか？」と使う事があります。
最後に疑問符についてですが、句点「。」を使っても、疑問符を「？」使っても意味はどちらも同じです。疑問符を使うこともたくさんあります。

教科書上ではそう書いてあるかもしれませんが、実用上は、「今は1時です。」としても問題はありません。
同様に、「アイス食べる？」は「アイスを食べる？」でも問題ありません。
疑問符も普通に使えますが、正式な文章を書くときには、疑問符や感嘆符は使いません。

目上の人には「今1時です。」よりも「今は1時です。」と答える方がより丁寧です。
「今何時ですか？」を使うときのほとんどは、深い意味もなく、ただ時間を知りたいときです。
対して、「今"は"何時ですか？」は、おっしゃる通り、現在・今の時間を強調する時に使えます。
