Question about English (US)

How do you say this in English (US)? Could you tell me what is correct?
1. Wasn't it late for my dad to not be here?
2. Wasn't it late for my dad not to be here?

I studied that if I want to say something negative using 'to' I should say like 'not to' but some people say just 'to not'.
