Algo que declarar sería más correcto en un contexto judicial mientras que algo a declarar, sin tilde por cierto, sería más correcto en un contexto en una aduana por ejemplo. Pero en esencia una se refiere a un hecho y otra a cosas materiales. Aunque nadie tendría problemas en entenderte ambas pueden resultar válidas.
