Okay, I see. Thanks for the clarification! Since it is a government document I think it would be better to call for an official answer. The first question might be asking if you’ve ever lived in the U.S. The second question is probably implying if you have ever visited(been to) the US. *I am not entirely sure if this is what the document is implying*

The second question sounds more natural when inquiring if someone has been to a certain place.
Example: Have you been to new mall yet? Have you ever been to Russia?
The only example I can think of in which you would use (in the US) would be “In the United States, there are many malls”

In my personal experience, I've been IN Korea, but I've never been TO Korea.
I was in the airport waiting on my flight (both arriving and departing). I never left the airport grounds, though I wanted to. TO implies that you have experienced it. IN is just physical.
But do check with the officials to be sure. That's just the case I would use it in.
