ネイティブの日本人は、あまり考えずに使っているかもしれません…この言葉がこの流れで使われている時ははこっちの方が自然‼って感じでなんとなくで使っているんだと思います。例で挙げられているもので説明すると、
○(あんなひどいことをした彼に)同情の余地はない
○(あんなひどいことをするなんて)同情の余地がないよねぇー※この場合は「同情の余地さえない」の方が自然かも。
というように。
すっきりとした説明が出来なくてすみません！

「〜は」と「〜が」はその文章の述語によって通常は決まります。
しかし例外もあり、その場合は主語を特別強調する意味になります。
以下、1)通常の場合と 2)例外の場合で説明します。
1)通常の場合
述語が名詞、形容詞の文章→「〜は」
例:この果物はりんごだ。
あの犬はかわいい。
述語が動詞の文章→「〜が」
例:田中さんが話す。
2)例外の場合
上の例文は全て「〜は」と「〜が」を入れ替えることができます。
しかし、そうすると主語が強調されます。
例:この果物"が"りんごだ。(他の果物はりんごではない)
あの犬"が"かわいい。(他の犬はかわいくない)
田中さん"は"話す。(他の人は話さない)
質問の例文では、「ない」は形容詞なので「同情の余地はない」が通常の場合となります。
「〜が」を使うと「同情の余地がない(他の余地はある)」という意味になります。

同情の余地はない、という場合は、それ以外の可能性があることを示します。
例
同情の余地はない。しかし、主犯にそそのかされてやっただけだ。
同情の余地がない、という場合は、それ以外の可能性があることを考えていません（それ以外の可能性を否定するわけではないので注意してください）。
例
同情の余地がない。だから重く罰してほしい。

まだ、書かれていない違いがあるので追加しておきます。
私は松前です。
と
私が松前です。
この2つの文章は表したい物事は似ていますが、既知と未知という分け方ができるそうです。（用語に自信がないのです。すみません）
は の場合、聞き手が話し手の名前を知らないと考えられるときに使います。
A：あなたは誰ですか？
B：私は松前です。
が は聞き手が名前を知っているが、”話し手”がどこにいるのかわからない時に使います。
A：松前という人を探しているのですが・・・
B：私が松前です。
この場合”は”と”が”は基本的に入れ替えられないです。
